Off-Label Communications Back in the Spotlight at the FDA
For the first time in almost 10 years, the U.S. Food and Drug Administration (FDA) released a draft guidance related to certain communications by firms to healthcare providers (HCPs) of scientific information on unapproved use(s) (SIUU) of approved or cleared medical products. The October 23, 2023, draft guidance, “Communications From Firms to Health Care Providers Regarding Scientific Information on Unapproved Uses of Approved/Cleared Medical Products Questions and Answers Guidance for Industry,” relates to communications including published scientific or medical journal articles (also known as reprints), published clinical resources such as clinical practice guidelines (CPGs), and firm-generated presentations of scientific information from an accompanying published reprint. Most notably, the draft guidance provides recommendations and considerations for digital publications and social media.

Wilson Sonsini Pro Bono Client Revive & Restore Successfully Advocates for New Vaccine Testing Alternative to Horseshoe Crab Blood
On August 22, 2023, the U.S. Pharmacopeia (USP) announced a long-awaited new regulatory chapter, known as Chapter <86>, which provides guidance on endotoxin testing using recombinant Factor C (rFC), a synthetic alternative to blood cells extracted from endangered horseshoe crabs. rFC can be developed at scale and eliminates the need for harvesting (bleeding) horseshoe crabs. The chapter reinforces the work of Wilson Sonsini client Revive & Restore, whose science-based campaign highlighted the efficacy and safety of the recombinant product for endotoxin testing.

On April 15, 2020, Kindred Biosciences (KindredBio), a biopharmaceutical company focused on saving and improving the lives of pets, announced that it has completed the sale of Mirataz® (mirtazapine transdermal ointment), a topical medication for use in cats, to Dechra Pharmaceuticals for an upfront payment of $43 million and royalties on worldwide sales.
