Brett Weinstein is Of Counsel in the New York City office of Wilson Sonsini Goodrich & Rosati, where his practice focuses on advising technology companies regarding privacy, data security, and consumer protection.
Brett has extensive experience with the Federal Trade Commission (FTC) and state attorneys general investigations relating to privacy and data security practices, the Children's Online Privacy Protection Act (COPPA), advertising practices, the Restore Online Shoppers' Confidence Act (ROSCA), and acts or practices alleged to be unfair or deceptive under Section 5 of the FTC Act (and state equivalents). Brett helps companies establish and maintain privacy and security programs and prepare for independent assessments of their practices. He conducts internal investigations, oversees complex eDiscovery, and prepares executives and employees for depositions.
Brett counsels clients regarding compliance with federal privacy laws, such as the Gramm-Leach-Bliley Act (GLBA), Telephone Consumer Protection Act (TCPA), Fair Credit Reporting Act (FCRA), and Family Educational Rights and Privacy Act (FERPA), and regarding comprehensive and sectoral state privacy laws, including the California Consumer Privacy Act (CCPA) biometrics regulations. Brett crafts privacy policies, drafts and negotiates data protection addendums, and assists with the response to data breaches and incidents. He provides strategic advice regarding forthcoming state privacy laws and potential rules and regulations in areas such as artificial intelligence and online child safety.
Prior to joining the firm, Brett worked in the privacy and data security practice at another major law firm in Washington, D.C. He was also a fellow at a law firm, where he assisted with law enforcement requests for information, litigation regarding encryption and the Video Privacy Protection Act (VPPA), fantasy sports and gaming law, and other internet and data privacy issues.
