In this edition of The PTAB Review, we examine trends in cases challenging biotechnology patents—that is, challenges to patents that issued from Technology Center 1600. We also analyze recent Federal Circuit decisions that will impact practice at the PTAB, including decisions on: collateral estoppel of IPR decisions; the burden of proof on questions of patentability in motions to amend; and extrinsic evidence that may be evaluated during claim construction.
