What's in a Review? The FTC's Updated Endorsement Guides and Proposed New Rule on Consumer Reviews
In late June 2023, the Federal Trade Commission (FTC) announced revised Endorsement Guides to strengthen and clarify guidance for advertisers and address emerging market trends concerning the use of endorsements and testimonials in advertising. The FTC also announced a proposed rule banning fake reviews and testimonials.

Last Call for the FTC’s Green Guides
The Federal Trade Commission (FTC) is in the process of updating its Guides for the Use of Environmental Marketing Claims (Green Guides) to assist marketers in ensuring that their claims about the environmental attributes of their products are truthful and nondeceptive. The Green Guides provide general principles that apply to all environmental marketing claims, as well as guidance on how consumers are likely to interpret particular environmental claims, how marketers can substantiate these claims, and how marketers can qualify their claims to avoid deceiving consumers. The Green Guides were first issued in 1992 and were subsequently revised in 1996, 1998, and most recently in 2012, so a new update is long overdue.

Wilson Sonsini Advises Lunar Energy on Acquisition and Corporate Matters as Company Emerges from Stealth
On August 24, 2022, Lunar Energy, a California-based start-up dedicated to delivering home electrification, emerged from stealth mode having successfully raised over $300 million in two rounds of funding led by Sunrun and South Korea's SK Group. Lunar Energy also acquired Moixa, the leading global software company for distributed energy resources (DER) management. In addition, ITOCHU and Honda, previous investors in Moixa, joined Lunar Energy's team of investors. Wilson Sonsini Goodrich & Rosati represented Lunar Energy in the financings, the acquisition, technology transactions, and general corporate matters.

N.Y. District Court Rules on Depictions of Products and Works in Video Games
Recently, the United States District Court of the Southern District of New York issued rulings regarding the depiction of "real world" content in digital environments. In both instances the cases were decided in favor of the game publisher, and the rulings provide guidance on how game developers and publishers should consider these issues.
