Daily Journal Recognizes Amy Candido as a 2023 "Top Trade Secrets Lawyer"
On October 25, 2023, Wilson Sonsini partner Amy Candido was recognized in the 2023 edition of Daily Journal's "Top Trade Secrets Lawyers" report, an annual list for top attorneys handling trade secret matters.
The accompanying profile spotlights Amy's role in high-stakes cases including one filed earlier this year where she represents biopharmaceutical company Avilar, life sciences and drug investment company RA Capital, and Dr. Deshpande in a trade secrets misappropriation and breach of contract lawsuit valued over $75 million. Amy also successfully represented Convoy, Inc. in a case brought by DAT Solutions, LLC alleging her client misappropriated trade secrets and breached contracts by creating a competing "load board."
In terms of emerging trends in the trade secrets field, Amy said: "Due to the prohibition on patenting abstract ideas and the limitation on copyright protection to works of human authorship, trade secret law has become essential to the protection of AI-related intellectual property and potentially AI-generated content. AI will challenge trade secret law to address many interesting questions, including what constitutes reasonable measures to protect a trade secret in the AI context, to what degree public training data may constitute a compilation trade secret, and how to measure damages in these nascent markets. And, as society becomes increasingly concerned about the responsible use of AI, we will need to reconcile calls for greater transparency and oversight with trade secret protection for AI."
Amy was recognized for her extensive experience in trade secrets and other IP disputes, as well as her dedication to advancing the practice of trade secret law through her leadership of a multi-year endeavor aimed at creating much-needed standard jury instructions for use in federal Defend Trade Secrets Act (DTSA) trials.
