Recently, the CNIL issued a draft recommendation on mobile apps that delineates the various roles and responsibilities of stakeholders involved in mobile apps development. It is open to public consultation until October 8, 2023, and is part of a broader action plan focusing on mobile apps.
The plan will pave the way for both online and off-site inspections of mobile apps, potentially leading to enforcement actions and significant fines. It echoes what led to enforcement actions against companies for cookie rule violations between 2021 and 2023.
Other European data protection authorities have signaled that mobile apps are a growing area of focus, raising the likelihood of future enforcement actions.
