International data transfers remain a cornerstone of global data governance, and recent developments are reshaping the regulatory landscape. Standard Contractual Clauses (SCCs), the most widely used mechanism for transferring personal data under the EU GDPR, are evolving. The European Commission is working on new SCC templates to address GDPR-bound data importers, complementing the 2021 version. Additionally, the Dutch Supervisory Authority recently imposed fines on Uber for non-compliance with GDPR’s data transfer requirements.
Meanwhile, other jurisdictions, like Brazil, have introduced their own SCC templates, aiming for EU adequacy. On a broader scale, the Data Free Flow with Trust (DFFT) initiative—a global effort originating from G20 and G7 discussions and now involving the OECD—aims to establish a framework for trust-based international data transfers.
